LEGAL INFORMATION

Terms of Service

These terms govern consultancy and production-related services supplied by Disley Media Limited. They also include our cancellation and refund policy and a concise privacy notice.

Effective date: 16 July 2026

Please read these terms before making a payment. A quotation, proposal, booking confirmation or invoice may contain additional project-specific terms. If there is a conflict, the project-specific terms will take priority for that project.

1. About us

Disley Media Limited (“Disley Media”, “we”, “us” or “our”) is a company registered in England and Wales under company number 17343389. Our registered office is PC223 Creative Industries Centre, Wolverhampton Science Park, Wolverhampton, West Midlands, United Kingdom, WV10 9TG. You can contact us at info@disleymedia.com.

2. Our services

We provide video production consultancy, music production consultancy, post-production and workflow advice, technical guidance and related project services. The precise scope, deliverables, timetable and price will be set out in our written quotation, proposal, booking confirmation or invoice.

Unless expressly agreed in writing, advice is provided for the particular project and information supplied to us. Results may depend on the client’s equipment, personnel, source material, third-party services and implementation decisions.

3. Forming a contract

An enquiry does not create a contract. A contract is formed when we confirm acceptance of the project or booking in writing, or when we begin providing the agreed services following your acceptance of our quotation or invoice, whichever happens first.

The person accepting a quotation or making a payment confirms that they are at least 18 years old and have authority to enter into the contract personally or on behalf of the named business or organisation.

You agree to provide accurate instructions, timely decisions, lawful source materials and any access reasonably needed to perform the services. You confirm that you own or have permission to use any material you supply to us, including music, footage, images, trademarks and personal data.

Delays in providing information, approvals or materials may change the delivery date and may result in reasonable additional charges where extra work is required. We will explain any material additional charge before carrying out that work.

6. Delivery, revisions and project changes

Any delivery date is an estimate unless we expressly confirm in writing that it is fixed. The number of included revisions, if any, will be stated in the project quotation. Requests outside the agreed scope may require a revised quotation and timetable.

You should review deliverables promptly and notify us of any material issue within 14 days of delivery. We will use reasonable efforts to correct work that does not materially match the agreed brief. This does not limit any rights that cannot legally be excluded.

7. Cancellation and Refund Policy

Before work begins. If you cancel before we have started work, we will refund sums paid for services not supplied, less any non-recoverable third-party costs that you approved in advance. Consumer cancellation rights described below take priority where they apply.

After work begins. If you cancel after work has begun, we may charge a reasonable amount for work completed up to cancellation and for approved, non-recoverable commitments made for the project. Any balance will be refunded to the original payment method.

If we cancel. If we cancel and cannot provide a reasonable alternative, we will refund amounts paid for services we have not supplied.

Consumer clients. If you are acting mainly outside your trade, business, craft or profession and contract with us at a distance, you will normally have 14 days from conclusion of the contract to cancel. If you expressly ask us to start within that period, you must pay a proportionate amount for services supplied before cancellation. If the service is fully performed within the cancellation period after your express request and acknowledgement, the statutory cancellation right may end. Nothing in these terms affects your statutory rights where services are not carried out with reasonable care and skill or are otherwise not as described.

Business clients. Statutory consumer cooling-off rights do not apply to a client purchasing wholly or mainly for business purposes. Cancellation rights will be those set out here and in the applicable quotation.

How to cancel or request a refund. Email info@disleymedia.com with your name, invoice or project reference, payment date, PayPal transaction reference and the reason for the request. Where a refund is due, we will normally process it to the original payment method within 14 days after agreeing the amount. Your bank or payment provider may take additional time to credit the funds.

8. Intellectual property

Each party keeps ownership of intellectual property it owned before the project. Unless the quotation states otherwise, ownership of our working methods, templates, know-how, project files and pre-existing materials remains with us.

Your licence to use, or ownership of, final deliverables will be stated in the quotation or proposal. Unless otherwise agreed, any licence or transfer is conditional on full payment. Third-party materials remain subject to their own licence terms.

9. Confidentiality

Each party will take reasonable care to keep the other party’s non-public commercial and technical information confidential and will use it only for the project. This does not apply to information already lawfully known, publicly available through no breach, independently developed, or required to be disclosed by law.

10. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any non-excludable consumer right.

For business clients, to the fullest extent permitted by law, we will not be liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or anticipated savings. Our total liability arising from a project will not exceed the total fees paid or payable for that project, except where liability cannot lawfully be limited.

Consumer clients may recover losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for business losses suffered by a consumer.

11. Events outside our reasonable control

We will not be responsible for delay or failure caused by events outside our reasonable control, including serious illness, equipment or network failure, interruption of third-party services, industrial action, severe weather or government action. We will contact you as soon as reasonably possible and take reasonable steps to reduce the effect.

12. Complaints and payment disputes

Please contact us first at info@disleymedia.com so that we can investigate. Include your invoice or project reference and a clear description of the issue. We aim to acknowledge complaints within five working days.

This section does not remove any right to contact PayPal, a card issuer, an alternative dispute-resolution body or a court. PayPal Buyer Protection and Seller Protection, where available, are governed by PayPal’s own terms and eligibility requirements.

13. Governing law

These terms and any non-contractual dispute are governed by the law of England and Wales. Business clients agree that the courts of England and Wales will have exclusive jurisdiction. If you are a consumer, you may bring proceedings in the part of the United Kingdom where you live and retain any mandatory protections provided by your local law.

If any part of these terms is found unenforceable, the remaining parts will continue. A delay in enforcing a right does not waive that right. We may update these terms for future projects; the version accepted for an existing project will continue to apply unless both parties agree otherwise.

14. Privacy Notice

Who controls your data. Disley Media Limited is responsible for personal information submitted through this website or provided in connection with an enquiry, quotation, payment or project.

Information we use. We may process your name, business name, contact details, enquiry and project information, correspondence, invoice details and payment status or transaction reference. PayPal processes your payment credentials; we do not receive or store your full card details.

Why we use it. We use information to respond to enquiries, prepare quotations, form and perform contracts, deliver services, maintain financial and project records, prevent misuse, resolve disputes and meet legal obligations. Our lawful bases may include taking steps at your request before a contract, performing a contract, complying with law and our legitimate interests in operating and protecting the business.

Who receives it. We may share necessary information with service providers supporting website forms, email, hosting, payment processing, bookkeeping, professional advice and project delivery. They may use the information only for the relevant service and legal obligations. We do not sell personal information.

Retention. Enquiries that do not become projects will normally be kept for up to 24 months. Contract, transaction and accounting records may normally be kept for up to six years after the end of the relevant financial year or longer where required for a legal claim or statutory obligation.

Your rights. Depending on the circumstances, you may ask for access, correction, deletion, restriction, portability or objection, or withdraw consent where consent is the basis used. Contact info@disleymedia.com. You may also complain to the UK Information Commissioner’s Office at ico.org.uk.

International services. Some providers, including payment and technology providers, may process information outside the United Kingdom. Where this occurs, we expect appropriate legal safeguards to be used.
